No one wants to be the target of an opportunist who brings an unjustified lawsuit because he preceives that you have money. Nor does anybody want to face a judgement larger than their insurance coverage. No one wants to have their estate pilaged while they are incapacitated. And no one has to endure this.

You would think in a community like Brea or Fullerton that such things would be rare. North Orange County has a fairly close business community made up of small businesses with a generous sprinkling of corporate giants. But Brea, La Habra, Fullerton, Placentia and other local communities see there share of opportunistic law suites. Fortunately the asset protection aspect of estate planning is something with which, Gerard W. O'Brien & Associates, can help you.

But even in sunny Southern California once the clouds of a law suit are on the horizon, it may be too late to protect your assets. When ever I speak to groups in Brea, Yorba Linda, Anaheim hills, or Fullerton about estate planning I always point out to the small business owners in the community that planning is something that should have been done yesterday or by today at the latest.

Asset protection has a bad name because it is often attempted when the judgement is about to be enforced. If you have planned early, approached your risk with adequate funding, and insurance, you can protect your assets in a legitimate manner.

What that really means is asset protection should be in place before asset acquisition or as soon as possible. What thwarts asset protection is a concept known as fraudulent transfer. Fraudulent transfers occur when you know you are about to be sued, or strongly suspect you are about to be sued and you transfer the assets in amanner that is preceived as hindering the enforcement of collection of a just debt.
